Terms of Service

1. Acceptance of Terms

By accessing or using SteamyForge and ThrillerForge (collectively, the "Service"), a product of Empathy Tech Solutions LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

These Terms apply in addition to the Company's general Terms of Service, which are incorporated by reference. In the event of a conflict, these product-specific Terms govern with respect to SteamyForge and ThrillerForge.

2. Description of Service

SteamyForge and ThrillerForge are AI-powered manuscript production solutions that assist authors in creating romance and thriller fiction respectively. The Service uses a proprietary AI engine to generate story premises, chapter plans, series bibles, and chapter prose based on user inputs.

The Service is a creative writing solution. It does not guarantee publication-ready output, and the quality of generated content depends in part on the quality and specificity of user inputs.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old;
• Accessing explicit adult fiction content is legal in your jurisdiction;
• You have the legal capacity to enter into a binding agreement;
• You are not using the Service on behalf of a minor.

We reserve the right to immediately terminate access for any user found to be under 18 or in violation of these eligibility requirements.

4. Accounts and Registration

Access to the Service requires registration with a valid email address. You are responsible for:

• Providing accurate registration information;
• Maintaining the confidentiality of your account credentials;
• All activity that occurs under your account.

You must verify your email address before generating content. We use your email address to manage your account and, with your consent, to send product updates and offers.

5. Purchases and Pricing

First Book Offer

New users may purchase their first book for $1, which provides access to the full manuscript production pipeline. The first book offer requires email verification. Output from the first book offer is subject to the same Terms as standard purchases, including content ownership provisions.

Paid Purchase

After the first book offer, each book purchase grants unlimited chapter drafts for that specific book project. Pricing is displayed at checkout and may vary based on promotional offers. All purchases are processed by LemonSqueezy, acting as Merchant of Record.

Payment Processing

All payments are processed by LemonSqueezy (Lemon Squeezy, LLC), acting as the Merchant of Record. By completing a purchase, you also agree to LemonSqueezy's terms of service and privacy policy. We do not receive or store your payment card information.

6. Refunds

Please refer to the Refund Policy for full details. In summary:

• Refunds may be requested within 14 days of purchase;
• Refund requests must be submitted through LemonSqueezy;
• We reserve the right to decline refund requests where substantial use of the Service has occurred.

7. Content Ownership and Intellectual Property

Your Inputs

You retain all ownership rights in the premises, character details, story concepts, and other creative inputs you provide to the Service.

AI-Generated Output

Subject to payment of applicable fees (or completion of a first book offer), you own the manuscript content generated by the Service based on your inputs. You may use, publish, sell, or otherwise exploit the generated content as you see fit, including for commercial publication.

Our Platform

The Service itself — including its software, user interface, AI prompts, genre DNA, and generation logic — remains the exclusive intellectual property of Empathy Tech Solutions LLC. You may not reverse engineer, copy, resell, or redistribute any component of the Service platform.

AI Training

Your manuscripts and inputs are never used to train our AI engine or any third-party AI model.

8. Acceptable Use

The Service is designed for the production of adult fiction within established genre conventions. You agree not to use the Service to generate:

• Content depicting minors (anyone under 18) in sexual, romantic, or exploitative situations, including content that uses euphemisms, age ambiguity, or fictional framing to circumvent this prohibition;
• Child sexual abuse material (CSAM) in any form, including fictional depictions;
• Non-consensual sexual content presented approvingly outside of established dark romance genre conventions where consent is an understood fictional framework;
• Revenge pornography or non-consensual intimate imagery depicting real or identifiable individuals;
• Content depicting sexual violence, torture, or killing for the purpose of sexual gratification (sometimes referred to as "snuff" content);
• Content depicting real, named individuals in sexual or intimate scenarios without their consent;
• Content that targets, harasses, threatens, or defames real individuals;
• Content intended to deceive, defraud, or harm others;
• Content that promotes or instructs in illegal activity;
• Content that violates applicable law in your jurisdiction.

Zero tolerance: Violations involving content depicting minors or CSAM will result in immediate and permanent account termination without refund, and may be reported to relevant law enforcement authorities. We reserve the right to terminate access without refund for any violation of this section.

9. AI-Generated Content — Important Disclosures

The Service uses a proprietary AI engine to generate manuscript content. You acknowledge and agree that:

• AI-generated content may contain errors, inconsistencies, or unexpected output;
• Generated content should be reviewed and edited before commercial publication;
• The Service does not guarantee that generated content is free of similarity to existing published works;
• You are responsible for ensuring that content you publish complies with applicable copyright law;
• The Company makes no representations about the commercial viability or publication-readiness of any generated manuscript.

10. Third-Party Services

The Service integrates with the following third-party services:

• LemonSqueezy — payment processing and Merchant of Record;
• Kit (ConvertKit) — email marketing and account notifications;
• Railway — backend hosting infrastructure;
• Cloudflare — content delivery and DNS.

We are not responsible for the practices, terms, or availability of third-party services.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations or quality standards. AI generation is inherently variable.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC BOOK PURCHASE GIVING RISE TO THE CLAIM, OR FIFTY U.S. DOLLARS (US $50), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorney's fees) arising out of:

• Your use of the Service;
• Content you publish or distribute that was generated using the Service;
• Your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Purchased book credits are non-transferable and non-refundable upon termination for cause.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in California under the rules of the American Arbitration Association. You waive any right to participate in a class action or class-wide arbitration.

Either party may seek injunctive relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

16. Changes to These Terms

We may update these Terms at any time by posting revised Terms with an updated Effective Date. Continued use of the Service after changes become effective constitutes acceptance. We will make reasonable efforts to notify users of material changes via email.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
